Will Waldron KC and Chris Allen secure £12.5 million settlement
February 10, 2023
Will Waldron KC and Chris Allen from Exchange Chambers have secured £12.5 million on a lump sum basis for a young boy who suffered life changing injuries after being involved in a road traffic accident when he was just 18 months old.
The claimant suffered a very severe traumatic brain injury as a result of the accident and will require 24-hour care/supervision for the rest of his life. The legal team fought for and won several contested interim payment applications to secure funding to enable the Claimant to attend a specialist residential educational institution where his educational and rehabilitation needs were met and the Claimant thrived as a result.
The parties met at a JSM in September 2022, but they were unable to agree settlement. With a trial for the assessment of damages due to take place in February 2023, settlement was eventually agreed shortly beforehand in the sum of £12.5 million on a lump sum basis. As the case is now the subject of reporting restrictions and an anonymity order it is not possible to provide any further details of the case.
Will Waldron KC and Chris Allen were instructed by Martin Hood from Jackson Lees Solicitors.
In respect of the settlement Chris commented “This settlement brings to a satisfactory conclusion a long drawn out and heavily contested case. It is comforting to know that all of the Claimant’s future needs are provided for, and it has been hugely rewarding to see the Claimant thrive so much in a residential school which his legal team fought so hard to secure the funding for. It has been a real privilege to have acted for the Claimant and his truly devoted family and an enormous pleasure to work with Will Waldron and the incredibly talented Martin Hood”.
Martin added “There were many contested issues and a significant number of applications over our years of conduct in this hard-fought case. Those sorts of circumstances demand highly experienced counsel who retain cool heads and offer excellent strategic thinking under intense pressure. Will and Chris delivered exactly that, and I was very glad to work with them.”
