Chris Barnes provides an update on the long-awaited appeal in Swift v Carpenter.
Practitioners have been following the progress of this appeal closely. Having originally been listed for determination last year, the hearing in March 2020 had to be adjourned due to the Covid-19 crisis. It has now been re-listed for hearing on 22nd June 2020.
The hearing will take place remotely, with expert evidence from an IFA, surveyor/valuer, economist and actuary. It is hoped that the Court of Appeal will bring clarity to the valuation of accommodation claims, both in the current negative discount world and more generally going forwards.
