Success for James Kinsey in multi-track trial – claimant awarded substantial compensation

James Kinsey from Exchange Chambers has secured substantial compensation for a seriously injured woman after a multi-track personal injury trial.

The trial was heard by HHJ Evans sitting at Manchester County Court. James’s client sustained third degree burns to her abdomen and significant psychological injuries. She had visited a beauty salon where the defendant performed a lipofreeze procedure upon the claimant’s abdomen.

HHJ Evans found that the defendant was negligent in her performance of the procedure. Notably, the defendant left the claimant unsupervised during the procedure and failed to advise the claimant how to release herself from the lipofreeze machine. When the claimant began to experience intense burning she was unable to extract herself from the machine and did not have a method to alert the defendant that she was in distress.

At trial, James’ client beat her CPR Part 36 offer and was therefore awarded increased, substantial compensation and costs.
