Success for Chris Richards in holiday illness trial
February 10, 2020
Chris Richards from Exchange Chambers has successfully obtained a substantial award of compensation for a Claimant who suffered an illness on holiday.
The Claimant had been on a package holiday to Mexico. Unfortunately, the food and drink provided by the hotel was unfit for human consumption. The Claimant was very poorly as a result, and spent time in hospital. The Claimant suffered stomach problems for several months, along with psychological trauma.
The Claimant brought a claim against the tour company. The tour company denied that they were responsible for the Claimant’s illness. The tour company instructed experienced counsel and solicitors and fought the claim all the way to trial.
The trial was listed in York County Court before a District Judge. Chris prepared a detailed skeleton argument, and made extensive submissions. The District Judge agreed that the food and drink had been contaminated, and that the contamination had caused the Claimant to be sick.
The successful Claimant was awarded over £6,000 in compensation, along with a substantial award of costs.
Called to the bar in 2016, Chris joined Exchange Chambers in 2017 after his Common Law pupillage and is now a member of the personal injury department. Chris was instructed by Pattinson and Brewer Solicitors in York.
