Tuesday 27th September


09:30 – 10:30 Gerard Martin KC – Amputation Masterclass

Maximising for amputees the recovery of the right award of damages for prosthetics. A masterclass using Gerard’s 30 years of experience representing amputees.

11:00 – 12:00 David Knifton KC and Chris Gutteridge – Amputation Case Study

David and Chris go step-by-step through two very different claims for lower limb amputees which have recently come to settlement for their clients with above and below the knee amputations.

12:30 – 13:30 Pankaj Madan – Dementia in Traumatic Brain Injury

Pankaj will look at dementia in traumatic brain injury claims and how to deal with it now.

Managing conflict in a Claimant’s family.

11:00 – 12:00 Bill Braithwaite KC and Sara Sutherland – Interim Payments

Bill and Sara will look at Interim Payments in claims involving serious injury. Interim payments are fundamentally important as treatment of the injury problems usually requires significant input from lawyers, and often means that private treatment has to be accessed.

Timing is crucial, because not having the money to do what is necessary, or running out of money when the treatment or rehabilitation package is unfinished, can be catastrophic.

Sometimes, but definitely not always, it is possible to have a principled and valuable discussion with a defendant about the availability and management of interim payments.

The next three sessions will discuss “Coming Home”

For the seriously injured client ‘coming home’ is one of the most important personal goals, and central to effective rehabilitation and rebuilding of family life. Using a case study drawn from real life examples, Matthew Stockwell and Mary Campbell, Brain Injury Case Manager, will be joined by key members of the multidisciplinary team to provide practical guidance on effectively managing this process – from property acquisition and adaptation, to discharge planning and seamless continuation of community rehabilitation.

egligence in RTA Claims Involving Children

James and Matthew will take an up-to-date look at investigation and presentation of RTA claims involving child pedestrians. Investigating child pedestrian claims and the role of the reconstruction expert. The assessment of driver and pedestrian visibility in determining whether and/or when a vulnerable road user could be observed, what does the published research say about how children’s capabilities differ from adults? Including perception and detection of traffic, conceptualisation of speed and distance, processing time, reaction times and decision-making, competency and awareness of danger, distraction, conventional wisdom and (misplaced) reliance on authority and practical considerations when investigating and
evidencing negligence.

Factors affecting head injury outcome after RTA to encompass all possible influences.

12:30 – 13:30 Chris Gutteridge, Mr Peter Jennings at TCRI and Dr Richard Lambourn at TRL – Forensic Collision Investigation and Expert Accident Reconstruction

Earlier this year, The Royal Society (in conjunction with the Judicial College) published “A Primer for Courts” on Forensic Collision Investigation. The guide (which is available here) is designed to assist judges in their interpretation of expert evidence on accident reconstruction and inform their determination of competing analyses from different experts.

In this session, Chris Gutteridge (who is an assistant editor of the Primer) will speak to two members of the Primer’s writing group about the key considerations for personal injury lawyers obtaining and deploying accident reconstruction evidence. As well as being key contributors to the Primer, Mr. Peter Jennings (TCRI) and Dr. Richard Lambourn (TRL) are experienced and renowned expert witnesses in the field. They will share their key insights into forensic collision investigation and tips for success in presentation of accident reconstruction evidence.

14:00 – 15:00 David Knifton KC and Liam McHale – My Journey

Liam is a former client who was involved in a serious RTA in 2014, at the age 14. Liam will talk from his personal experience and will talk about his injuries, rehabilitation, his medical experts and legal team. Liam will tell you about what life was like before the accident and what life is like now. The setbacks he has suffered following his brain injury and most importantly his achievements.

 

Friday 30th September

Chris tackles the notoriously complex Defective Premises Act 1972 and provides a thorough review of recent case law.

Pitfalls in cases concerning fraud, exaggeration and LVI.

12:30 – 13:30 Trudi Moore and Caitlin Edwards – Taxi Credit Hire Claims and the Implications of Hussain v EUI Ltd

The talk will aim to inform the audience when it is appropriate to bring a loss of earnings claim, over a credit hire claim, and the best way to present it/navigate the process.
