We are delighted to invite you to our Annual Personal Injury Event 2023.
“Adding Value”
This year we are delighted to be holding some of our training days in person however we still have a Zoom day for those not able to join us.
For days one and two Monday and Wednesday, the theme is “Adding Value” and will cover a range of talks from our Personal Injury team, with day 3 from more junior members of Exchange looking at lower value cases.

Day 1 – Monday 16th October, by Zoom
9:30-10:30 – Chris Gutteridge: Vulnerable Parties and the CPR: invoking the Overriding Objective and PD1A in case management of catastrophic injury claims
Chris Gutteridge will discuss the most recent amendments to the Overriding Objective which require the Courts to ensure vulnerable parties can ‘fully participate’ in proceedings and give their ‘best evidence’. Chris will consider the practical implications of PD1A and the decision in AXX (A protected party by his litigation friend XRE) v. Zajac [2022] EWHC 2463 as well as providing tips on how a severely injured claimant’s ‘vulnerability’ can be addressed within the process of case and costs management.

12:30-13:30 – Matthew Stockwell: Effective Case Management and Cost Budgeting in High Value PI and CN Cases – an update and practical guide
Matthew will look at some of the more contentious aspects of case management in the context of high value claims, give real-world advice on getting budgets correct and approved first time, look at growing experience under the recent CPR changes and PD1A (vulnerable parties and witnesses), rehabilitation considering Hadley v Przybylo, and other traps, tips tactics.
14:00-15:00 – Sara Sutherland, Dr Jude Joughin (Child and Educational Psychologist) and Deeba Akram (Speech and Language therapist): Brain Injuries in Children
Our speakers will consider brain injuries in children:-
When should we assess? What does this assessment involve and what do we need to ensure a realistic picture of the future? Difficulties experienced by children from a SaLT and Education perspective and can we predict them? What about pre-existing conditions and can we determine what would have been? How do we ensure we have accounted for cultural diversity and how certain is our prognosis?

9:30-10:15 – Trudi Moore and Caitlin Edwards: Witness Statements
This talk will cover a range of issues which can arise when drafting a witness statement, in low value matters through to the multi track. There will be advice on form and content, and how best to structure one which sets out the relevant detail persuasively. The talk will also cover issues which often arise when preparing a witness statement for a witness whose first language is not English.

11:45-12:30 – Chris Richards: Protecting yourself in claims involving minor limitations in capacity for employment
Chris looks at the best way to deal with personal injury claims where a Claimant has suffered from a fairly minor restriction in their employment. What should you be claiming? What evidence should you be obtaining? How can you slay the ‘prof neg’ dragon?
