09:30 – 10:30 – Louis Browne QC – Considering Issues of Life Expectancy in High Value Personal Injury Claims
This talk will consider the types of claims in which life expectancy is an important issue, the expert evidence needed to address it and a suggested approach as to how best to utilise that evidence in Counter Schedules and JSMs
11:00 – 12:00 – Alice Dobbie – Exaggeration and Fraud: A tactical approach
This seminar will evaluate strategies in fraud cases, including how defendants’ varying objectives in different cases may affect the tactical approach. It will also address the issues which arise where the suspected fraud is subtle or only relates to a modest proportion of the pleaded case, and survey recent High Court authorities on this point
12:30 – 13:30 – David Sandiford – Secondary Victim Claims
David Sandiford will discuss secondary victim claims, providing a useful and pragmatic guide to the principles and case law in this often difficult and developing area of the law
14:00 – 15:00 – Andrew Ward – Provisional Damages in Catastrophic Injury Litigation
In this talk, Andrew will discuss the general principles of provisional damages; the strategic consideration for a Defendant of “buying off” provisional damages with an increased lump sum offer; and the specific issues arising in TBI cases concerning an increased risk of post-traumatic epilepsy and of dementia
15:30 – 16:30 – Helen Rutherford – Defending Holiday Illness and Injury Claims
Helen will discuss defending holiday illness and injury claims, with a spotlight on approaches to expert evidence on gastrointestinal illness and local standards

Roger will look at defending occupiers liability claims and a review of relevant caselaw
11:00 – 12:00 – Hedley Nield – Resiling from Admissions
Hedley will discuss resiling from admissions, focusing on interesting cases
12:30 – 13:30 – Pankaj Madan – Liability in Catastrophic Road Traffic Accidents
Pankaj will consider the principles and factors that determine both primary liability and the extent of contributory negligence in catastrophic road traffic accidents involving pedestrians. He will deal with whether it is possible to categorise types of accidents involving pedestrians to see whether there is a common theme which can assist a prediction of the result and some tips for Defendants who face such claims
