POCA Hearing success for Eddison Flint

Eddison Flint from Exchange Chambers has successfully acted for his client in a Proceeds of Crime Act (POCA) Hearing.

POCA relates to the recovery and confiscation of proceeds made from criminal activities and money laundering.

At the POCA hearing, which took place because no agreement could be reached regarding the financial benefit and amount to be confiscated after the defendant’s involvement as a courier in a large-scale drugs conspiracy, the Crown sought to attribute over £60,000 of payments into the defendant’s bank accounts to “criminal earnings”.

The Crown’s assertions were successfully rebutted by Eddison Flint and the defendant’s benefit figure was ordered at just over £500, allowing him to keep his house and vehicles for work.
