Insolvency
Scott is regularly instructed in insolvency matters, both in the personal and corporate context, and appears frequently in winding up and bankruptcy lists. In particular, Scott has experience in:
- applications to set aside statutory demands;
- applications to annul bankruptcy orders;
- company restorations;
- remuneration applications;
- rectification of the companies register;
- administration extensions; and
- income payment orders.
Recent insolvency instructions of note include:
- acting on behalf of liquidators at a contested winding up hearing where the debtor company had entered into creditors’ voluntary liquidation following presentation of the petition;
- successfully obtaining a contested bankruptcy order with a petition debt of circa £3.7 million;
- advising the director of a company in liquidation as to the legality and effect of a purported re-assignment of a debt ledger; and
- drafting a defence to a claim under sections 216 and 217 of the Insolvency Act 1986 (the so-called ‘phoenix company’ provisions).
