Insolvency

Scott is regularly instructed in insolvency matters, both in the personal and corporate context, and appears frequently in winding up and bankruptcy lists. In particular, Scott has experience in:

  • applications to set aside statutory demands;
  • applications to annul bankruptcy orders;
  • company restorations;
  • remuneration applications;
  • rectification of the companies register;
  • administration extensions; and
  • income payment orders.

Recent insolvency instructions of note include:

  • acting on behalf of liquidators at a contested winding up hearing where the debtor company had entered into creditors’ voluntary liquidation following presentation of the petition;
  • successfully obtaining a contested bankruptcy order with a petition debt of circa £3.7 million;
  • advising the director of a company in liquidation as to the legality and effect of a purported re-assignment of a debt ledger; and
  • drafting a defence to a claim under sections 216 and 217 of the Insolvency Act 1986 (the so-called ‘phoenix company’ provisions).
