Scott has a busy and diverse commercial practice, and acts for both claimants and defendants such as lenders, insurers and insolvency practitioners in a variety of commercial matters, including contract and tort claims, company disputes and debt recovery actions. Scott appears regularly in the County and High Courts in interlocutory hearings, applications and trials both in person and remotely, and has particular experience in:

  • Applications for set aside;
  • Strike out applications;
  • Summary and default judgment;
  • County Court injunctions;
  • Debt recovery;
  • Charging orders;
  • Costs and case management hearings;
  • Applications for pre-action disclosure; and
  • Defending claims under sections 140A to 140D of the Consumer Credit Act 1974 on behalf of lenders.

Notable commercial cases of Scott’s include:

  • provision of an advice and draft pleadings in an intimated breach of contract dispute valued at circa €600,000;
  • resisting a High Court application to set aside default judgment and a charging order in the value of approximately £140,000, with costs obtained for the successful respondent;
  • drafting a defence, counterclaim and part 20 claim in respect of an action under section 3 of the Torts (Interference with Goods) Act 1977 valued at circa £100,000;
  • Advice and drafting pleadings for a claim valued at £150,000 in breach of contract and negligence arising out of a claim as to defective animal feed.
