Kirsty undertakes all aspects of commercial litigation and dispute resolution representing both Claimants and Defendants in contract, banking, and company disputes, as well as debt recovery. Kirsty is regularly instructed for strike out and summary judgment applications, applications for interim relief and case management hearings. Kirsty is also able to advise on contractual disputes including issues of construction and interpretation.
Kirsty’s recent work includes:
- Drafting a defence and successful strike out application in a claim where a prisoner was suing his higher education facilitator for various breaches of contract, harassment and discrimination.
- Advising on merits and strategy, and subsequently draft particulars of claim, regarding a contractual dispute concerning the sale of medical gloves, worth over £2,000,000. This involved advising on the application of and compliance with the Medical Devices Regulations 2002 and the Medical Devices Directive 93/42 and advising on the required expert evidence.
- Representing local authorities in contested applications for liability orders.
- Advising a client on whether they are eligible for the Right to Buy scheme and any remedies available against the local authority.
