March 18, 2022
Julian King from Exchange Chambers successfully defended a police sergeant accused of gross misconduct in a 3-day hearing held at Derbyshire Constabulary Headquarters in Ripley.
PS J was accused of breaching the standards of “Use of Force”, “Authority, Respect and Courtesy” and “Discreditable Conduct”. Sergeant J was a custody officer who delivered a punch to a violent detainee. It was alleged that his actions were in retaliation to a kick delivered by the detainee. After 3 days, the Panel concluded his actions were necessary, proportionate and reasonable in all the circumstances. The Panel found there were no breaches of any of the Professional Standards of Behaviour.
Julian King was instructed by Mark Wardley of Straw & Pearce Solicitors.
