Exchange Chambers team secure convictions in multi-million pound nursing home fraud

Benjamin Myers QC, Nicola Daley and Ray Smith have secured the conviction of luxury nursing home owner, David Barton and his general manager Rosemarie Booth after a trial at Liverpool Crown Court.
Vulnerable and childless residents at Barton Park Nursing Home in Southport had been targeted, groomed and financially abused over a period of 16 years. They were defrauded of millions of pounds. David Barton went on to bring a fraudulent civil claim for almost £10 million against the estate of one of the deceased residents.
At the end of the trial, which lasted just over twelve months, the defendants were convicted of multiple counts of conspiracy to defraud and David Barton was convicted of offences of theft, money laundering and false accounting.
Describing David Barton’s offending as one of the most serious cases of abuse of trust ever to come before the courts of this country, the trial judge, His Honour Judge Everett sentenced him to a total of 21 years imprisonment. Rosemarie Booth was sentenced to 6 years’ imprisonment.
