David Sandiford acts for Defendant against Leading Counsel in High Court Fatal Accident Claim

David Sandiford from Exchange Chambers has recently concluded a very high value High Court fatal accident claim.
The claimant was represented by both Leading and Senior Junior counsel. David advised one of the two defendants from the outset following an in-house instruction from a large regional utilities provider and later the Head of Casualty at Mills & Reeve, Birmingham.
The claim involved diverse and complex liability issues necessitating experts in three disciplines including accident reconstruction. Quantum was equally challenging involving the trajectory of a post retirement medico legal career. Forensic accountants were instructed on both sides and David handled quantum on behalf of both defendants.
An interesting feature of the case was a direction at the PTR for supplementary skeleton arguments for the trial judge on proposed issue by issue concurrent expert evidence (hot tubbing).
The claimant ultimately discontinued the claim a matter of days before the week long trial was due to commence.
