Court of Appeal set to cast aside Ghosh test for dishonesty

Leveson LJ has given what seems like a clear indication that the Court of Appeal will adopt the obiter comments of the Supreme Court when they cast aside the Ghosh test for dishonesty in the civil cheating case of Ivey.
In DPP v Patterson (2017) EWHC 2820 (Admin), he said “…it is difficult to imagine the Court of Appeal preferring Ghosh to Ivey in the future.”
No doubt the Court of Appeal will settle matters once and for all at the earliest opportunity.
