Chris Barnes KC successful in the Upper Tribunal

Chris Barnes KC represented MD in his appeal to the Upper Tribunal, Administrative Appeals Chamber. The appeal related to an application for compensation under the Armed Forces Compensation Scheme following an accident in which MD suffered catastrophic spinal injuries whilst serving. The application was initially rejected, and rejected on appeal to the First Tier Tribunal, on the basis that the accident had not occurred in service. Chris made written and oral submissions in support of an application for permission to appeal following which Upper Tribunal Judge Hemingway granted permission and indicated an intention to allow the appeal without hearing further submissions, subsequently ordering accordingly.

Chris previously recovered substantial damages for MD in his civil claim against the MOD.
