Celestine Greenwood appears before Court of Appeal

Celestine Greenwood from Exchange Chambers, led by Deirdre Fottrell of 1GC, appeared before the Court of Appeal on Friday 5th March when the Court was asked to consider whether, and if so, the circumstances in which care orders and special guardianship orders can coexist.
In particular the Court is asked to consider whether an SGO can and should continue post the removal of children from the care of the special guardian to allow the SG, here a non-biological ‘parent’, to retain parental responsibility and thereby status in the life of a child. The Court is also asked to consider the imposition of conditions on the SGO. Judgment is eagerly awaited.
It is the second Court of Appeal appearance for Exchange Chambers’ family law team in recent months. Celestine, led by Deirdre Fottrell QC and Liz Brennan, led by Frank Feehan QC, also took the fight for revocation of placements orders to the Court of Appeal. Judgment was handed down on 27 November 2020.
