A brain injury survivor has hope and security for the future after lawyers worked collaboratively to settle a complex personal injury claim.

Pankaj Madan, instructed by Ann Allister and Jenny Malam from Carpenters, secured a settlement of over £2 million for the claimant, now an adult, who suffered a traumatic brain injury and severe left sided paralysis in a road traffic accident whilst a child.

Ann and Jenny from Carpenters and Pankaj Madan worked closely with the defendant’s legal team, Andrew Kerr and Nicola Overmire at Clyde & Co in Manchester, instructed by Aviva Insurance Company, who fully engaged with the Rehabilitation Code and funded multi-disciplinary rehabilitation.

The claimant regained the ability to walk, engaged and worked hard in academic study and went on to a good university.

The claimant team also worked collaboratively with their experts to explore the need for professional care and support. case management, future treatment and the need for single storey accommodation were all explored and evidence obtained to support potential future needs.

Commenting on the case, Pankaj Madan said:

“This case shows what collaborative working and early effective rehabilitation can achieve – a young life restored with hope and security for the future.  It also demonstrates the benefit for all in funding private education as the claimant’s overall progress can be directly linked to exceptional academic performance.”

Called to the Bar in 1997 and with over two and a half decades at the forefront of personal injury law, Pankaj’s career is marked by a deep commitment to serious injury cases. His practice is rooted in a profound understanding of the intricacies of brain injuries.
