£4.8 million for a 10 year old boy who suffered a serious brain injury
February 5, 2014
Amanda Yip QC and Chris Gutteridge, instructed by Imogen Wetton of Thompsons Solicitors, have secured a settlement of £4.8 million for a 10 year old boy who suffered a serious brain injury after being knocked down while crossing the road.
The claim presented a challenge as liability was disputed and the insurers refused to make any interim payments. Faced with a choice of litigating liability or seeking to find a compromise, the team secured the cooperation of experts and worked hard to reach a realistic valuation much earlier than would usually be expected.
The lump sum settlement will allow the family a degree of flexibility in meeting the claimant’s needs throughout his lifetime. The settlement was approved by Mrs Justice Swift, a judge with vast experience in personal injury litigation, who endorsed the compromise as properly reflecting the litigation risks and being in the child’s best interests.
Commenting on the settlement, Amanda Yip said “This was a real team effort to get a result that will allow this young boy the treatment and rehabilitation he badly needs now while also ensuring his long term needs are met. The family was delightful and inspirational to work with and I really hope that the settlement will give them the comfort and security they deserve as they seek to rebuild their family life.”
