£2.3 million settlement for Will Waldron K.C. and Andrew Ward

Will Waldron K.C. and Andrew Ward from Exchange Chambers represented a claimant, WP, who suffered a severe Traumatic Brain Injury (“TBI”) and left-sided hemiplegia when a cast iron soil pipe fell onto his head as he footed a ladder at work in the construction industry. The impact penetrated the claimant’s skull.

The case was complicated by the insolvency of the tortfeasor employer. The claimant proceeded against the employer’s insurer under the Third Parties (Rights Against Insurers) Act 2010. Liability was admitted.

A settlement of £2.3 million was negotiated at a Joint Settlement Meeting in October 2024. Will and Andrew were ably assisted throughout the case by their instructing solicitor, Kerri Kershaw, Director, of Ward Hadaway LLP.
