£1.6 million settlement for Andrew Ward

Andrew Ward from Exchange Chambers has secured a settlement at a Joint Settlement Meeting in February 2021 of £1,610,000 on behalf of a claimant who sustained a serious left foot fracture and avulsion of the heel pad when he was knocked off his motorcycle by a car in May 2016.
The treating doctors and the parties’ respective medico-legal experts in Orthopaedics and Rehabilitation Medicine agreed that the Claimant would benefit from an elective below-knee transtibial amputation although surgery would not be a medical necessity. There was a question-mark over the Claimant’s intention to undergo surgery. He had received appropriate input from a multi-disciplinary rehabilitation team but had opted for conservative treatment for nearly five years. The claim was presented on the basis that it was inevitable that he would come to an elective amputation within a further three years.
Andrew was instructed by Gerard Horton and Gemma Roberts from Fletchers Solicitors. Andrew commented:

Very importantly, his compensation includes provision for private prosthetics and suitable accommodation if he elects to undergo a transtibial amputation. Apart from raising a contributory negligence argument that had no merit – and that the claimant would have pursued to trial – the defence team was very constructive and helpful.”
